Bays Cemetery, Rhodes Cemetery & Scott Cemetery

Bays Chapel Community, Montgomery County, Texas

James H. Collard received a headright grant of three fourths of a League and one Labor from the State of Texas (Volume 15, Page 81). He sold part of this land to Thomas Bay (Deed Q, Page 93). In 1859, Thomas Bay and Mary, his wife, sold three hundred seventy-nine acres, more or less, of land originally received by James H. Collard as a headright grant, to Mary G. Carrington, executrix of the estate of William E. Carrington for $ 3800, SAVE AND EXCEPT one-half acre of land around and including the grave yard on said tract of land.

 

This Is The First Part Of Bays Chapel Cemetery

On 25th of May 1921, Elizabeth B. Rhodes, sole heir of Mrs. M. G. Carrington’s estate of the county of Grimes sold for $15 to the Citizens of Bay Community two acres of land out of this three hundred seventy nine acres. It is referenced as beginning at the Northeast corner of the present cemetery enclosure known as the Bays Community Cemetery. The purpose and intention of this conveyance was to convey for said cemetery purposes the present location of said cemetery and as much more as is herein described as will be sufficient to make two acres. (Vol 102, Page 208, Montgomery County Deed Record).

 

On 20th of August 1907, Mrs. E. B. Rhodes of County of Montgomery sold for Five dollars to J. N. Scott a parcel of land in the North Western corner of Montgomery County particularly described as being in the Rhodes Grave yard (which is near to Bay Grave yard (now known as Bays Chapel Cemetery). The tract conveyed was: Beginning at a stake for corner two feet west of the NW corner of the Picket fence enclosing the grave of T. P. Carrington, West 20 feet, South 20 feet, East 20 feet and North 20 feet to beginning containing 400 square feet. Conveyance to J. N. Scott was for use as a cemetery. (Deed Vol. 44, Page 427).

 

On January 6, 1925, the heirs of Mary G. Carrington to J. S. Bunn and Mintau Bunn (also one of heirs) of Hidalgo County, TX the property, except for the ½ acre of land including the grave yard on said tract of land. The heirs listed are: (Deed Vol. 113, Page 303):

 

E. B. Rhodes of Bexar County, TX; Mrs. N. L. Rhodes, widow of S. E. Rhodes; Lillian Mize joined by her husband, D. J. Mize, all of Grimes County, TX; Mrs. H. M. Rhodes, widow of O. W. Rhodes of Harris Co, TX; Bernard E. Rhodes of Brazoria County, TX; Ollie Beavens joined by her husband P. R. Beavens, of Harris County, TX; John B. Rhodes of Harris County, TX; L. A. Rhodes of Harris County, TX; Virgil M. Rhodes of Harris County, TX; Bessie Rhodes Pilkenton, joined by her husband, F. L. Pilkenton, of Wichita Co, Texas; Jason M. Chandler of Limestone County, TX; Willie C. Wood joined by her husband W. C. Wood, of Oakdale, LA; Bryant Butler of Harden County, TX; Effie Scott Hammett, joined by her husband, T. T. Hammett, of Hunt County, TX; and Mrs. Mintau Bunn and her husband, J. S. Bunn all being the only surviving heirs of Mary G. Carrington.

 

In February 2000, Mr. Alton Hues, the current owner of said property, brought me the following list of stones from the Scott Grave Yard:

 

Rufus B. Scott d 1885; John N. Scott 1829-1913; Susan (probably Scott) 1828-1905; James D. Scott 1860-1929. He told me that there was also a tombstone which has been removed by someone that was for about 1861.
 

Mr. Hues is combining the name of Rhodes, Scott and Hues Cemetery as he has buried his mother in said cemetery as well. Said cemetery will include both tracts of land, the ½ acre Rhodes Cemetery and the 20 x 20 ft. Scott plot. He is currently having the cemetery surveyed.

 

We are interested in any additional information for any one interested in or having knowledge of burials in these old cemeteries. We are also interested in finding anyone with knowledge of burial of T. P. Carrington. In 1870 census, Thomas P. (T. Preston in legal documents) age 29, born VA with $5000 real estate and $3000 personal property is living with Ben W. Rhodes 46 and his wife Eliza B. Rhodes 36, born VA and the Rhodes children, Sam E. 17; Oliver W. 15, Alice 12 and Efford B. 10. They are living in Longstreet Pct., Montgomery Co., TX.

 

This information will enable us to correctly update cemeteries in the county. We urge all of you to forward us information about old family cemeteries that are known to exist on private property. O
